What Evidence Do You Need to File a Wrongful Death Claim in Tennessee?

To file a wrongful death claim in Tennessee, you need several key documents, including a death certificate, medical records, medical bills, crash reports, proof of income, and funeral or burial expense records. These materials help explain what happened, confirm losses, and support the claim review process.

The death certificate serves as a foundational document. It confirms the cause of death and the date it occurred. Insurance companies and courts often require a certified copy before reviewing any claim related to a fatal accident.

Medical records and medical bills also play an important role. These documents show the treatment provided after the crash and link the fatal injuries to the incident. Hospital records, emergency care notes, and billing statements help outline the medical impact leading up to the death.

A crash report provides an official account of the accident. It usually includes the date, location, involved parties, and a summary of what was documented at the scene. This report often becomes a central reference for insurers and attorneys when reviewing a wrongful death claim.

Proof of income may also be necessary. Pay stubs, tax returns, or employer records can help show lost earnings or financial contributions the deceased provided. These records help explain the economic impact on surviving family members.

Funeral and burial expense documentation is commonly included as well. Receipts and invoices related to services, burial plots, or cremation costs help outline expenses tied to the loss.

Keeping insurance correspondence, claim numbers, and written communication organized can also be helpful. These records provide context and help track how the claim progresses over time.

A wrongful death lawyer can help explain how these documents are used in Tennessee claims. Legal guidance may clarify which records apply and whether additional documentation may be needed. An attorney can also explain what types of compensation may be available, depending on the circumstances.
