Who Has the Right to File a Wrongful Death Lawsuit After a Tennessee Crash?

Fatal Multi-Vehicle Crash Shuts Down Hwy 70 W Near Mealer Rd

In Tennessee, the deceased person's spouse has the first right to bring a claim. If there is no surviving spouse, the right often passes to children or other close family members under state law.

Tennessee law sets rules about who may act on behalf of the victim's estate. A surviving child may file if the spouse is not available. Parents may also have the right to pursue a claim if the victim did not leave behind a spouse or children.

These rules help determine who can take legal action after a deadly collision.

Wrongful death lawsuits often involve both emotional and financial losses. Families may seek compensation for funeral expenses, medical bills, and lost income the victim would have provided.

The process depends on the circumstances of the crash and the relationship between the survivor and the deceased.

A wrongful death lawyer can help explain who qualifies to file and what documentation may be needed. An attorney can review reports, discuss deadlines, and clarify what options may be available under Tennessee law. Legal guidance can help families understand the process without making assumptions about the outcome.

At DZ Law, we have experience reviewing fatal crash cases across East Tennessee and explaining victims available legal steps for them.
